Business Issues Breakfast Forums

Presented by CRE Business Issues Subcommittee
Chair: Michael S. MaRous, CRE, President, MaRous & Company [bio]
Vice Chair: Alyce B. DeJong, CRE, Vice President, Prudential Investment Management [bio]

It’s among friends in a trusted environment that frank and provocative discussions can be fostered. Choose a Forum that matches your specialty or select a subject you want to know more about. Each Forum provides a meaningful opportunity to interact with fellow Counselors, ask questions and share experiences and advice. Some Forums will feature guest speakers; others are moderated dialogues.

Enjoy breakfast AND great conversation at the popular CRE Business Issues Forums.

Discovery Issues and Challenges Facing Testifying Valuation Experts in Eminent Domain and Real Estate Tax Litigation

Forum Co-Chairs: Edward W. Dinan, III, CRE, President, Dinan Real Estate Advisors
Raymond A. Jackson, CRE, Director, Integra Realty Resources-Cincinnati/Dayton [bio]

Panelists: Edward Dinan, III, CRE, President, Dinan Real Estate Advisors
Marjorie Stern Jacobs, Esq., CRE, Attorney, Ballard Spahr LLP [bio]
Michael S. MaRous, CRE
, President, MaRous & Company [bio]

Panelists will address discovery issues and challenges facing testifying appraisers and other valuation experts, clients and attorneys, particularly in the context of eminent domain and real estate tax litigation. They will tackle such thorny questions as whether an appraiser must disclose e-mail communications or drafts of appraisal reports or permit the review and copying of the contents of his or her work files. Factual circumstances, privileges and other protections, USPAP requirements and a wide variety of factors relevant to “discovery” will also be discussed.

The panelists are all Counselors: two experienced attorneys who work with testifying and non-testifying appraisers and other valuation experts and two experienced appraisers who have served as expert witnesses. Attendees will leave this session with a better understanding and appreciation of the nature, scope and ramifications of discovery and with practical suggestions for dealing with anticipated or pending discovery efforts.

Whether or not you attend the behind-the-scenes tour of PETCO Park on Sunday – or Monday’s ball game – you will gain critical insight into the concerns of each party involved in this high profile project, how these concerns were addressed, and what it took to resolve the many challenges that arose from this complex yet highly successful Public/Private venture.

Attendees will have the opportunity to hear hands-on perspectives from each party involved – an unprecedented opportunity to see behind the scenes of this massive venture. Join a lively discussion that will be candid, thought-provoking and enlightening.
