Panelists will address discovery issues and challenges facing testifying
appraisers and other valuation experts, clients and attorneys, particularly
in the context of eminent domain and real estate tax litigation.
They will tackle such thorny questions as whether an appraiser must
disclose e-mail communications or drafts of appraisal reports or
permit the review and copying of the contents of his or her work
files. Factual circumstances, privileges and other protections,
USPAP requirements and a wide variety of factors relevant to “discovery”
will also be discussed.
The panelists are all Counselors: two experienced attorneys who
work with testifying and non-testifying appraisers and other valuation
experts and two experienced appraisers who have served as expert
witnesses. Attendees will leave this session with a better understanding
and appreciation of the nature, scope and ramifications of discovery
and with practical suggestions for dealing with anticipated or pending
discovery efforts.
